you guys are cheaters but the natural rights philosophy in fact does not protect trial by jury. The natural rights philosophy is a very individualized theory, and by introducing a trial by jury you are establishing a less limited government and actually moving back towards classical republicanism.

The right of a trial by jury is your right to choose if you want your case decided by a government employee or other citizens. The government's right to decide your fate is limited in that respect.

A trial by jury is a Constitutional right to have your fate in a criminal trial determined by a jury of you peers instead of the judge. The judge is part of the government and it is limited because you have the right to take the choice from the government's hands.
