Back in the early days of the USA, they never thought the constitution would be challenged, as it was very straight forward. Soon there after, a challenge was made that constitutional right were being violated by the servant government.

Having never thought that the constitution would be challenged, no part or government was set up to decide such things. this is when the supreme court took it upon themselves to have the say. Nobody could think of much of a better idea so it has stuck.

The supreme court doesn't protect the constitution. They simply interpret it. Some justices have a strict interpretation of the constitution and others like to believe that the constitution should be interpreted to suit the needs of the day.

So in some ways, the constitution is protected by those justices that keep its meaning literal, though it is still simply an interpretation which is a fancy word for opinion. This can obviously have detrimental effects for those who wish for the constitution to remain as written and only altered in meaning by amendment.
