When accused of sexual harassment, you probably should:

  1. Keep a diary of who you speak to about this, the person's title, the date, time and what you were told.
  2. Ask for a copy of any written report first. If told you cannot have the copy, ask for a reason.
  3. Ask for the person in charge (your supervisor, boss, police) to read to you or to tell you, clearly, the accusation made.
  4. LISTEN very closely -- the story may not be correct. You may have an explanation.
  5. THINK very seriously about the complaint. Review in your mind what you did or said, what you intended, how the situation went.
  6. ASK how you can tell your side of the story. If the accuser's version is written, you might have to answer in writing.
  7. If you know you're guilty or that it looks pretty bad for your side, you might want to ask for 24 hours before giving your answer. However, if it got blown out of proportion or you were misunderstood, you might want to say so right away.
  8. Call an attorney first, especially if you have to put your version in writing. Most lawyers give a 30-minute free consult. Follow the attorney's advice if you think it fits your situation. Sexual Harassment can cost you your job; it's a serious matter. If the police are involved, it can be even worse.
  9. Most importantly, stay away from the accuser. Do not call the person or attempt to pressure them to change their story. Do not get alone with the person; always meet with someone else, like the supervisor, boss, police.
  10. IF you truly did nothing wrong, or think you were misunderstood, be classy and apologize: I'm truly sorry if my words made you uncomfortable.
  11. If you are still employed....You will likely need to agree to "terms", or "terms" may be forced upon you. For example, the other person could file for a restraining order/order of protection to keep you away. If you work in the same office, you could lose your job.
  12. IF you committed a wrong, do something to actively change your attitudes and behavior. You might volunteer to attend a sexual harassment workshop or seminar, or to talk to a therapist. But again, consult an attorney first because there are many points to consider.
  13. Learn from any mistakes you made. An off-color joke might be offensive to some. Staring at (breasts, pelvis, buttocks of either sex), making comments, sexual jokes, or coming onto a person can cause extreme discomfort and even fear. Even asking for a date can be perceived as harasment. Be blatantly honest with yourself--and get help if you need to change your words or actions.

even though you may feel totally violated and uncomfortable, you have to tell somebody. It's wrong and that person deserves to be punished. You can't let this happen again so tell somebody.
