One of the arguments for not having a Bill of Rights was the thought that it would be misconstrued to mearly be a list of your rights. There should be further information on this debate in the Federalist and Antifederalist Papers.
Primary federalist, James Madison believed that a Bill of Rights to protect citizens was unneeded because the proposed constitution gave no powers to the federal government to take upon itself, the rights already granted to citizens by way of the state constitutions. The proposed Constitution was given no rights to take away citizen rights already in existence.
