There was no Peace Treaty, because there had never been a declaration of war (as Congress had never recognised the Confederacy as a sovereign nation).

The various Confederate armies surrendered, one by one, starting with the Army of Northern Virginia under Robert E. Lee on April 9th 1865. In mid-May, the Southern cabinet held its last meeting, where it wound-up the Confederacy. All Confederate troops were supposed to sign a pledge never to take up arms against the United States. They would then receive an official pardon, and a promise that they would not be persecuted.

Some senior officers refused to do this, and fled to Mexico. The Confederate President Jefferson Davis tried to do the same, wearing women's clothes as a disguise, but was recognised and arrested, earning some contempt for his conduct.

The last battle of the civil war was in Petersburg, Virginia in April 1865. This battle is known as the battle of "Five Forks". General Robert E. Lee and his Confederate soldiers were at their defenses in Petersburg when they were attacked by the Union and were forced to retreat toward Lynchburg, Virginia. The Confederate president Jefferson Davis and his cabinet were forced to flee Richmond, Virginia because of the threat of the Union soldiers in Petersburg.

Carolina, having been defeated in March 1865 by General William T. Sherman at the Battles of Averasboro and Bentonville. Once Lee had surrendered, and the Confederate capital having fallen, Johnston realized the war was all but lost. He met General Sherman between the Union and Confederate lines at a small farm near Hillsborough, North Carolina known as Bennett Place (A NC State Historic Site). The two generals met on three occassions, finalizing the surrender, which ended the fighting in North Carolina, South Carolina, Georgia, and Florida. The surrender signed on April 26, 1865 surrendered more than 89,000 Confederate soldiers, becoming the largest surrender of the American Civil War

The last battle was at Palmito Ranch, Texas, May 12-13, 1865. It was a Confederate victory. Also, Johnston had only 30,000 men when he surrendered. However, he was authorized to surrender other units not under his direct command. There were many battles after Petersburg.
