The following questions are adapted from the article, "30 Interview Questions You Can't Ask and 30 Sneaky, Legal Alternatives to Get the Same Info," HR World, September 28, 2009:

  1. whether you have a religious affiliation (and/or what it is)

  2. what religious holidays you observe

  3. your native language

  4. how long you've lived in the United States

  5. whether you belong to any social clubs or organizations

  6. your age

  7. how long you plan to work before you retire

  8. your marital status

  9. whether you have, or plan to have, children

  10. whether you would work during a pregnancy, and whether you would come back after maternity leave

  11. whether you can get a babysitter on short-notice

  12. the name of your closest relative (in case of emergency)

  13. what your parents do for a living

  14. whether you can do the job as well as a man/woman

  15. whether you are comfortable being supervised by, or supervising a man/woman

  16. your opinion on intra-office dating

  17. whether you smoke or drink

  18. whether you take drugs

  19. your height or weight

  20. how many sick days you took in the past year

  21. whether you have any disabilities

  22. whether you've had any past illnesses or operations

  23. whether you've ever been arrested

  24. whether you were honorably discharged from the military

  25. whether you are in the National Guard or Reserve

Most of these questions aren't illegal, per se, but should be considered warning signs of potential discriminatory hiring practices. Employers may ask questions that are relevant to performance of the job; some of which may be similar to those above (for example, while they can't ask about prescription medication, they can ask if you use illegal drugs.)
