If it hits on the left side of your car, obviously your positioning on the road is wrong.

Another VIew: Other car speeding or not, it is the car that turned into the path of the oncoming traffic that is At Fault. You were either inattentive, or if youir depth and speed perception of moving traffic is THAT bad, you ought not to be driving.

Going ONLY by the information contained in the question: If the other driver struck you - then they are at fault. On the other hand, if YOU struck them, you MIGHT be at fault depending on whether they stopped before entering the roadway or not. It mainly comes down to a question of who had the last chance to stop, yield, or avoid the collision.

Another view: First: any car that intends to pass another, HAS TO be travelling at a greater speed than the car they're passing.

Second; Did the turning car signal their intention to turn?

Third: Unless passing was prohibited on that particular stretch of road the turning car should have been alert to the possibility that they could be passed.

From the bare facts disclosed in the question, it is my belief that, unless they were being passed in a No Passing Zone, the turning vehicle was at fault for turning into the path the the passing vehicle.

Basically if you are hit by an oncoming car while turning left, it is your fault unless they failed to stop for a red light or stop sign.

the other guys fault doesn't he see you right in front of him because the reaction time would be long enough for him to hit the brakes unless you live in England then its your fault
