Usually the fault lies with the person who was behind you, if you were on public streets. However, if you were pulling out of a parking space on private, not public, property then the responsibility is yours. I live in British Columbia, Canada and ICBC has changed their laws where if a person hits you from behind it can often be YOUR fault. My girlfriend was just in an accident and doing all the right things. She had her left signal on and was making the turn into the other lane when a guy on a racing motorcycle came up behind her trying to get around her to make the light and his her back end so hard he flew over the hood of her car and landed in the meridian. She was shocked to learn it was 100% her fault. We looked up the laws and that's the way it was. Of course I disagree with this law as many do. Makes it easier for ICBC paying out claims.
