In the US a surviving spouse is responsible if the married couple resided in a community property state or the spouse accepted the responsibilty by signing a written agreement. If such is not the case and the deceased had no unexempt assets that can be used to pay medical expenses the debt becomes null and void. Surviving children or other relatives are not responsible for the debt unless they signed a written agreement accepting responsibility.

∙ 14y agoThe estate has to resolve all debts. If there was a co-signer or the insurance was held by another individual (usually husband), they may be held accountable. If there are not enough assets to pay off the debts, they are not resolved.

∙ 12y agoYes yu are responsible for your spouse's medical bill. due to the fact there are community property laws a judge could easily call a judgment to pay for hospital bill of your spouse. However some hospitals are willing to give you a cut in bill to square off a quick deal, due to death inurance paid for deceased mate issued. On the otherhand some hospitals offer patient support programs from volunteer donators, to assist indiviuales who due to low income , on fixed income or personally ill themselves, can fill out a hospital form requesting help with hospital donation committee to qualify for payment dismissal.
