That would be the car backing up because you can't see the other car coming at you and more than likely the other car wouldn't see you either.
In Canada it's the person backing up that would be at fault considering you were slowing down for a stop sign. If you happened to be speeding and came around a corner and hit the person backing out that is a different story.
If it was an open intersection, the driver turning left is at fault. If there is a traffic signal, stop sign or one way street involved, it could be either driver, depending on circumstances.

Obviously if they are driving recklessly and too fast they cause the accident but from the eyes of the police,they put you at fault,when you back up you have to check for pedestrians and any car movement. make sure the cars blocking your visibility had not been parked illegally,that can be a decisive factor to avoid any claims just in case you go to court.
