There is no jury because the plaintiff has elected not to demand a jury. A court case with no jury is referred to as a "bench trial" because the judge will decide both the issues of law and issues of fact and make a decision.

Another View: While civil rights cases ARE heard in federal court, "property damage" suits are seldom, if ever, heard ithere as they fall under the purview of the state courts.
