Could we freely answer many of these questions without the Bill of Rights? No, because we have freedom of speech.
That's only one of the things the 1st amendment promises, yet there are 10. Please, think about this. It's really quite easy.

∙ 15y agoYes. The "Bill of Rights" are actually a set of amendments to the US Constitution, and are still some of the most commonly cited (and debated) amendments today. Freedom of speech, the right to bear arms, and the right not to incriminate oneself are all part of the Bill of Rights.

∙ 6y agoI believe that the Bill of Rights is necessary, yes. Many of the Founding Fathers didn't feel it was necessary because it was so obvious, but I think that anything that isn't written down and codified can be easily eroded... as we have seen with the right to privacy in this country (alluded to in the fourth amendment "to be secure in their persons, houses, papers, and effects"). Every time we see a bad guy getting away with something because of that right we go and give more of it away, until it is almost not even there at all, for any of us.
If there weren't a Bill of Rights, then I think over the years even more rights would have eroded... not only for all people, but for specific groups that have been traditionally discriminated against. Even now, the right to religious freedom is challenged frequently, and "excessive bail" is questionable. There are places trying to make laws about bearing arms and protesting, which are rights that can be easily eroded as well. I've had cops stop me just walking down the street or parked in a parking lot before (and I wasn't breaking any laws, by the way). If people in power didn't have limits placed on what they could legally do, a lot of them would abuse their power more than they do already.
It's tough, because there are a lot of things that we have now that we didn't have when the Bill of Rights was written, so the courts have a tough job interpreting the law for today's world. But that is why they are there, I suppose.
