Because it was only a Proclamation, not an Act.

It applied to the Southern states - in other words, the states over which Lincoln had no authority at that time.

It was really meant for the ears of the British and French, warning them that they could no longer help the Confederates without declaring themselves to be pro-slavery.

The proclamation not actually freed any enslave people because only the ones that signed it got free and the ones that didn't sign it weren't free.
