possible faulty brake light switch...sticking....usually located on top of metal arm connecting to your brake pedal. $10 part. There's a rubber bumper that the brake pedal switch hits against to turn off. When the bumper gets old it falls off (you will notice the pieces on the floor when you get in). Without the bumper in place the switch post just goes through the hole that the bumper is supposed to be in and is never depressed and the brake lights don't shut off.
The most likely cause of this is a mis-adjusted, broken or malfunctioning brake light switch. It could also be something holding the brake pedal down just a little bit (adding an aftermarket pedal will do this).
Check that the brake is actually connecting with the brake light switch. It is possible that the rubber stopper that hits the switch has fallen out.
Check at the base of the brake if the rubber bushing is ripped around it, it will not lift the brake pedal up enough off the switch to let the lights turn off.
