The Affordable Care Act Penalty

The poor and others who can't afford to buy a qualified Health Insurance Plan will "Not" be arrested or placed in jail. But you can rack up significant taxes and interest penalties.

Under the Affordable Care Act. Failure to maintain the required minimum Health care coverage is a Misdemeanor offense against the Federal Code of Law. The penalty for the misdemeanor is assessment of a fine. The Internal Revenue Service is the designated collection agent and instructed in the Act to collect the fine in the same manner as it collects taxes. This is why the U.S. Supreme court declared the fine a tax. opining that the congress was not empowered to assess a fine for not engaging in commerce but that it could impose a tax for non participation in commerce. Effectively redefining the penalty as a Tax.

The Affordable Care Act specifically precludes the IRS from seizing property or person for failure to pay the taxing fine. It does not however preclude the IRS from seizure of taxable revenue streams nor of credit refunds otherwise due to those who can't afford the required coverage.

Although the Afordable Care Act itself declares a fine, the Supreme Court defines it a tax.

They don't. Under Obamacare, if an individual chooses not to purchase health insurance under the mandate, he/she will be required to pay a penalty tax. However, a section of the bill states that an individual will not be held liable for criminal prosecution if he/she refuses to pay the penalty.
