It is not fraud if it was done inadvertently. The effect would be that the lease is invalid. The question would be the extent of the damages incurred. If there is a great deal of money involved you should consult with an attorney who can review the situation and determine what your options are. Perhaps the husband could sue for half of the rent money that was collected and also require that the tenant must move out.
