That depends on their age and not their grade, and that is defiined by the statutes of the state or country in which they reside. Age of consent varies state by state in the US. In some states there is a difference based on the age gap of the parties in question. Do an internet search for your state's statutes, and then search for age of consent with those statutes (laws).
