Felons are not prevented from getting married. Brothers and sisters are commonly used as witnesses. I take it that 'here' means the United States. If you are legally married in Costa Rica, you are legally married in the US. You would have to get the marriage annulled or get a divorce to legally get married again.

No. Persons who are considered to be illegally within the US cannot apply for resident status even if they are considered legally married to a US citizen. Federal law applies to immigration issues not state laws, so, it is conceivable for an illegal immigrant to legally marry a US citizen but that does not give she or he US legal status or the right to apply for such.
First of all If they are legal they can't be illegal. Second, you can marry anyone you choose to.
I have more of a comment: I noticed in my research that it seems harder for a person who was brought here as a child when they had no say than for and adult who is here illegally. Why are there more ways for a CAnadian to be here legally than a Mexican national. Especially, ones brought here as children.
It depends how the immigrants got here - and what skills they brought with them ! If they came here legally through due process, and brought a skill that is needed - then yes they do - HOWEVER - if they came here illegally in the back of a truck, JUST to get a 'better life' than that had in their home country - then no they don't.
