Age

Section 23(1) of the Constitution Act, 1867, sets out that a person must be at least 30 years old at the time of appointment to the Senate. (This means that the maximum term for a member of the Senate, pursuant to section 29(2), is 45 years.)

Citizenship Status

Section 23(2) of the Act sets out that a person must be a natural-born subject of the Queen at the time of appointment to the Senate, or that they have been otherwise made a naturalised subject by an Act of Parliament (i.e., through standard citizenship rules).

Property

Section 23(3) of the Act sets out that a person must own real property at the time of appointment to the Senate, and that the property must be in the province for which the senator has been appointed a representative.

Value

Section 23(4) of the Act sets out that a person's property in the province of appointment, required under section 23(3), must be worth at least four thousand dollars (CAD$4000) at the time of appointment.

Residence

Section 23(5) of the Act sets out that a person must be resident in the province for which the person is to represent in the Senate. In addition to this requirement, persons who are appointed to represent Québec in the Senate must be resident in one of twenty-four senatorial divisions.
