How do you protect your home when owning a business?

Several important methods exist for a business owner to protect his home (and other personal assets) from liabilities incurred in the course of operating the business. The first line of defense is to establish (and operate) the business a separate legal business entity. The basic forms of legal business entities are corporation, limited liability company ("LLC"), and limited partnership. Limited partnerships are the best form for only a handful of specialized businesses, such as real estate holdings. The choice between corporation and LLC is more complicated, but either corporate form will provide a level of protection for the personal assets of the business owner, including the home.

Corporations and LLC are created by making the appropriate filings with the Secretary of State. Once the corporate entity is created, the operations of the business must be kept separate and apart from the owners personal assets - for example, the corporation should maintain separate bank accounts and the assets needed to operate the business should be purchased and owned by the business. If the business maintains a separate identity, complies with reasonable the corporate formalities, and owns the assets needed for operation, the corporate entity should shield the business owner from personal liability, thereby protecting his home and other personal assets.

Business insurance warrants a separate mention. If the operation of the business creates a potential for causing injury - either due to product liability, or errors and omissions - the business should seriously evaluate purchasing insurance. Technically, insurance purchased by the business is an asset of the corporation that may be needed for the reasonable operation of the business. (Many business operations pose no significant risk, and liability insurance is not needed. These businesses should evaluate the need to obtain insurance against risk of loss - for the same reason that you carry homeowner's insurance.)

Additional protection for the home is afforded to married couples (in most states) by allowing for ownership of the home as a "tenancy by the entirety." Property held under a "tenancy by the entirety" may not be subject to liens for liabilities created by one of the parties. If the business is owned by only one of members of the couple, the home cannot be attacked to satisfy any liabilities that may pierce the corporate veil.
