Is it illegal to kill grackles in Texas?

Generally, it is legal and ok to kill them in Texas if they're causing a nuisance or health hazard. While they are not exotic and are still technically protected from sport or fun shooting, many would consider them constantly a nuisance, and in that case, they may be controlled by killing, as approved by both state and federal law. This is summarized from state law on the TPWD website:

http://www.tpwd.state.tx.us/huntwild/wild/rehab/protected/

Wild Birds: All wild birds that migrate through or are indigenous to Texas, along with their plumage or other parts, eggs, nests and young are protected from harming, killing and/or possession by state and federal law except that European starlings, English sparrows, and feral pigeons may be killed at any time and their nests and eggs may be destroyed. A permit is not required to control grackles; cowbirds; yellow-headed, red-winged, rusty or Brewer's blackbirds; crows or magpies when these birds are considered a nuisance or causing a public health hazard. No birds may be controlled by any means considered illegal by local city or county ordinance.

http://www.tpwd.state.tx.us/regulations/fish_hunt/hunt/nongame/

  • Unprotected Birds:
    • The only birds not protected by any state or federal law are European starlings, English sparrows, feral rock doves (common pigeon, Columba livia) and Eurasian collared-doves; these species may be killed at any time, their nests or eggs destroyed, and their feathers may be possessed.
    • Yellow-headed, red-winged, rusty, or Brewer's blackbirds and all grackles, cowbirds (does not include cattle egret), crows, or magpies may be controlled without a federal or state depredation permit when found committing or about to commit depredations on ornamental or shade trees, agricultural crops, livestock, or wildlife, or when concentrated in numbers and in a manner that constitutes a health hazard or other nuisance.

Is a speeding ticket a misdemeanor in indiana?

"Speeding in Indiana referred to as an Infraction. This is a civil offense, compared to something like public intoxication which is a misdemeanor. Essentially, being cited with an infraction means that you have to pay a civil fine. There is no immediate worry of jail time." Quote by Jeffery Michael Haupt, Criminal Defense Attorney, South Bend, IN. Found on Avvo site, 2012.

What laws govern driving a restored 1955 military m32 ambulance on state highways and roads?

A vehicle that old would be classified as an "antique" vehicle to which modern equipment laws would not necessarily apply. You would have to check with your state DMV to determine how they treat something of this description.

How do you plead innocent on a underage possession of alcohol charge?

Contact the municipal or justice of the peace court where you are supposed to appear. Most will require you to appear in person to enter a not guilty plea. You cannot have a court appointed attorney for a class C misdemeanor, so you can either hire one or represent yourself. There are some defenses to minor in possession, and I would suggest you read up on Chapter 106 of the Alcoholic Beverage Code if you plan to represent yourself.

Is it illegal to kill armadillos in Texas?

Why did Texas overturn its state law criminalizing same-sex marriage?

On June 26, 2003, the United States Supreme Court, in Lawrence v. Texas, ruled that the Texas statute which made consensual homosexual activity between adults a Class C misdemeanor was unconstitutional because it violated the Due Process clause of the U.S. Constitution. Since that date, the Texas sodomy law, as well as that of any other state, cannot be enforced. The Texas Legislature, however, has yet to repeal the statute, perhaps as a sign of defiance against the federal government. Nevertheless, that statute is null and void.

Is it legal to have a pet monkey in Texas?

Chimpanzees cannot be pets. As babies, they are easy to care for and can pretty much be raised as a human child. However, once they reach adolescence, they become 7-10 times stronger than a human. No matter how loving a relationship a chimp has with their human family, there is always the possibility they will lose their temper and attack, or attack a neighbour. Not even the trainers in Hollywood can handle them after this, and usually get rid of them or keep them in cages their whole lives after a childhood of severe abuse.

Also, it is not kind to the chimp. When they become too strong to handle, many zoos cannot take pet chimps, because chimps learn their social skills from watching the members of their community as they get older, and they do not know how to interact properly with other chimps. They also cannot be put into the wild for this reason. Sanctuaries are usually full to capacity. Some owners are so desperate they resort to sending their chimp to a biomedical lab to be used as a research subject. Not to mention the fact that these baby chimps are taken from their mothers to be raised by humans. This has exactly the same effect it would on a human mother and child.

Chimps are also very endangered in the wild, and keeping them as pets gives the impression that the species is stable, when nothing could be further from the truth.

If you love chimps, do some research and help protect them in the wild, or fundraise or volunteer for a sanctuary. But never ever ever get a pet chimp. It ends badly for all involved.

In Texas is it legal to shoot someone if they are robbing your house?

Yes. Texas's self-defense law is pretty broad, and you have the right to defend yourself, your family and your property. The caveat is that you have to reasonably believe that the force you use is necessary to prevent the robbery (or harm to yourself or others).

What are your rights in Texas when the repo man is trying to repo your car?

    • You have the right to surrender your vehicle to the lender voluntarily.
    • You have the right to try to prevent the repo agent from recovering your vehicle, but you have a right to an attorney when you are arrested for actively attempting to hinder a lender in the recover of their collateral.
    • You have the right--no, that's a responsibility--to pay the loan as you contracted to pay it.
    • Once the vehicle is recovered, you have the right to claim any personal property you foolishly left inside the vehicle, and to pay the storage lot the fees they assess for storing it for you.

    That's about it.

What happens if the father of the child is court ordered to pay child support and refuses?

A court order for child support is not a court order for visitation. These are 2 different issues and needs to be petitioned for separately. If there is a court order for visitation she can not say no without breaking it and can then be reported to the court and even lose custody if repeated. Child support is not a must for visitation. The court cares about the child having the right to both parents so if one can not pay at the moment does not mean they are not allowed to see each other. There is after all many mothers on welfare so technically they can not pay for their child either but they have custody. If there is no court order I suggest you go to court to get one.
