Some states do forbid parties to a phone conversation from recording it without the knowledge (not necessarily the explicit consent) of the other party. Even then, it may not be "illegal" in the "you'll go to jail for doing this" sense, though it usually is "illegal" in the "you can't use the recording as evidence in court" sense.
