With the exception of Plastic Man, Blackhawks, and the Spirit, all Quality Comics characters, as originally depicted, have fallen into the public domain. The new versions of those characters ("retcons") are property of their respective companies.

The Marvel Comics character is not, but if you wanted to start your own comic with a character named Thor, as long as your Thor is distinct enough from Marvel's that the two could not be confused, then you should be fine.
