According the the Arkansas Fair Debt Collections Practices Act § 17- 24-301 no person, partnership, association or corporation shall charge as a collection charge or fee an amount in excess of fifty percent (50%). However, the debtor can only be charged these fees if explicitly agreed to when the debt was created, by written agreement or notice provided at the point of sale. Generally, collections firms try to slam these charges onto the debtors to be able to attract more clients by claiming its a free service. These fees do not include interest and there are additional rules for bad checks.
