Minor children are not allowed to make the decision as to which parent they prefer to reside. If the parents cannot come to a equitable solution concerning primary custody the decision is made by the judge. Judges sometimes interview older children about the school they attend, friends, and activities they may be involved in such as a sports team. The judge's decision however, will be based upon what is in the best interest of the child and not the preference of others.

No. The child is well within his/her rights to choose not to see the non-custodial parent. However, the non-custodial parent still contributed to that child being born, and is therefore required to help provide for him/her.

But if you keep the child and you are not the custodial parent and there is a court order saying the other parent is the custodial parent, all that person has to do is call the police, and the non custodial parent would have to give up the child.

Wanting to keep that type of information secret shows a problem of non-cooperation and a parent who is not thinking of the best interests of the child.

File what? If you are speaking of a court filing, either parent. If you are speaking of taxes the custodial parent has the right to file the child as a dependent. The custodial parent can allow the non-custodial parent the right if they want to.
