It can be, however it is not mandatory. Generally, any overpayment is considered a gift, which is why it's important to frequently monitor payments. State agency are notorious in their poor accounting habits. see link below

In recent months, this issue has been raised due to a problem that has developed in the way that weekly payroll child support deductions are being processed. Eight percent of the payments are being classified as gifts, rather then support, leaving an unpaid amount of support by the end of the year.
