A minor can be charged with murder. It is even possible that they will charged as an adult. Most states will not allow criminal charges against a child that is 12 or younger. It is generally beleived that they do not have the mental capacity to understand the results and cosequences of their actions, therefore they cannot have the mens rea required to prove intent.

murder can only be the case if there is a proof beyond reasonable doubt that the child plotted to kill the deceased (e.g. eyewitness saw she intentionally puts a poison on food saying "I will give it to Arvin so that he will die").
if this is the same case then it is indeed murder but children are heavily protected by laws that the lawyer can use to minimize the charges to the murderer since the kid is a minor (don't know exact laws and it varies in every country).
