Technically it is a crime. But, if they want to try it, sure they can but they will eventually be caught and jailed for the act. Depositing a check that was stolen or a check that belongs to someone else is a crime and is punishable by law. When the owner of the check that was lost files a complaint with the cops, the destination where the check was cashed can be easily traced and the person who cashed it can be easily caught and punished.

No, not unless you know the persons account number, and you can't put it as your own account number if that's what you're thinking; that would never work. ;)

But do not worry, as the person of whom's check you've found will probably realize it is missing and tell the sender to cancel the check, and have another one sent instead
