You cannot get HIV from a non infected person, because they are not a carrier of the virus. However, HIV can appear dormant (meaning an HIV test will show up negative) for quite a while, which means you could become infected even if the person had a negative test (but happened to carry the virus).

Engaging in unprotected sex (including anal/oral) is risky not just because you could become infected with HIV. There are a ton of nasty infections and diseases you can pick up which could have been avoided by using a condom.

Yes AIDS is transmitted from person to person by the transfer of fluids such as blood, saliva or seminal fluid. Even if no blood is present, ejaculate would carry the virus and if it came into contact with a cut or recent injury, then there is a good chance of it being passed on.
