The guy who said that if you're an illegal immigrant with a misdemeanor, you get deported is wrong. It depends on which state you live in. Democratic states are more likely to let an illegal immigrant go simply by paying the bail charges. In a republican state, the illegal immigrant may not be so lucky (I don't know the answer for a republican state).
If he is an illegal immigrant he probably will be. If he is legally in the coutnry he will be afforded the same court privileges as a citizen.

It is not clear just what it is that is being asked. If you're illegal, you're illegal. If you domestically assaulted someone and they take you into custody, you will be deported. If your domestic partner assaulted you, they can be charged, but you will still be deported.
