This depends. The US has a 'List of crimes of Moral Turpitude' that it consults when deciding whether to permit entry to an individual with a criminal record. This list includes offences such as murder, rape, forgery, prostitution and fraud. If you have a criminal record that is included in the list, and this record is discovered by US customs, you risk arrest, seizure of your assets, possible incarceration, and a lifetime ban from entering the United States.

That said, if you committed a crime not considered to be of moral turpitude, you will most likely not encounter difficulties entering the US (although I make no promises).

If you have committed a crime of moral turpitude and wish to travel to the US, you can apply for what is known as a US entry waiver. Once granted, this waiver will allow you to legally travel in the US for a specified time period (usually 1-5 years). Hope this helps!

Can you be fired for your husband's criminal record?

I would not think so. If you have been there for awhile. If you are a new hire, they can certainly do that. If you are applying, they can not hire you for that reason. Your husbands criminal history has nothing to do with your criminal record. It would be unlawful to fire you because your husband has a criminal record. If that were the case, then anyone married to a felon would be considered a felon too.

Can a person who has never committed a crime have a criminal record?

No. If you've never been arrested you will not have any criminal record. If you are required by an employer to certify to this fact, all you have to do is request a criminal check on your name and you will receive a form that states that no record was found for your name/DOB. Do not confuse a criminal record with a DMV record. If you have a driver's permit, you WILL have a DMV record.

How does an employer find out if you have been charged with a criminal offense?

Can you have a charge taken off your criminal record that's been repealed?

Under the ex post facto rule, you cannot be charged with a criminal offense if it was not a criminal offense at the time you committed it. By the same token, if you committed a criminal offense that has since been repealed (meaning this is no longer a criminal offense) you still are considered having a criminal record for that offense.
