From the 2003 International Residential Code:

311.5.6 Handrails.

Handrails shall be provided on at least one side of each continuous run of treads or flight with four or more risers.

- Maximum riser height allowed by code is 7 3/4" and you would need to have 3 or less risers to omit a handrail. The answer would be 23 1/4" max.

You should have a safety rail on anything above a normal step... 7" or more.
