I do not know whether homework is legal by US law, however if you take UK laws literally homework is not legal, this is because schools in the UK are legally not allowed to interfere with your lives outside of school. (With the exception of the well being of children. E.g. being harmed by adults) It is also illegal as any work done outside of school MUST be payed for by law. (This is a law to prevent Legal Slavedom)
I have never heard of states having a homework requirement. This is usually left up to local school districts to decide. For example many districts have a minimum homework requirement of 30 minutes a day and a maximum of one hour.
currently there are not, there is talk of them, but so far none have been put in place. schools can chosse to limit homework if they want. which is really bad because homework sucks.

Yes it is legal to give homework over any holiday break. You are not required to do the actual work during a time you are religiously prohibited but you are expected to have it completed somehow by the due date.
