A theory is what somebody believes may explain a situation.

A fact is something that has been proven, or is commonly accepted (i.e., the sun will rise tomorrow morning). It can't be a fact because it is a prediction of the future. But if I had to bet, I would wager my life savings on the sun rising tomorrow morning!
