POA's can only be obtained if the grantor is willing and is mentally capable of understanding the nature of the procedure. In cases where the mentally incapacitated person needs assistance and cannot grant POA the interested party must apply for adult guardianship through the appropriate state court (usually probate). Adult guardianship is expensive ($3,000-$5,000) and often complicated as the legal definition of incompetency is not necessarily compatible with the medical definition of such. A competency hearing is required in almost every state. Also in every state the person(s) applying for guardianship must retain legal counsel and the person in question must have a Guardian Ad Litem appointed by the court. The best option is to obtain legal advice from a qualified attorney.

No. The child support was owed to the custodial parent and not the child. Would it be legal for a child with no living family to live with an unrelated adult without obtaining legal guardianship and what would be the ramifications?

In the United States it would not be legal. You haven't included any details about the relationship between the child and the unrelated adult who wouldn't be able to enroll the child in school or obtain medical treatment. That would set the stage for the adult and child to have to lie about the child's status. There is a concern that taking unofficial custody of an undocumented orphan could set the stage for child abuse. If and when the authorities are alerted, the Department of Child Services would take custody of the child and place her/him in foster care and the unrelated adult might be the subject of an investigation to determine why they didn't report the child's situation to the proper authorities. The adult with whom the child is living should visit the probate court and petition for a legal guardianship. If possible they should consult with an attorney who specializes in custody issues.
