No. At 17 she is still a minor even though she is having a baby. Legally, that doesn't make her an adult. If she was legally emancipated she could, but that is a legal process that requires a lawyer and to go before a judge.

And I ask this, because I suspected that you believe you're emancipated when in fact you are not, because given your age and situation there is no way that you met the requirements for emancipation. Unless the 17 year old son is an emancipated minor, he is still subject to the rules and discipline of his parents. If he is still a minor and having sex with the 23 year old she can be charged with child, or statutory, rape. Or, she could be reported as contributing to the delinquency of a minor. You're undoubtedly right to be concerned about this, but don't expect your son to thank you for this interference in his life

Are you already emancipated? If not, and your only purpose for becoming emancipated is to be allowed to marry...well, you would still have to meet all the requirements for emancipation.
