I actually think he was sentenced to death. But Atticus wanted to appeal it to the supreme court justice. Unfortunately Tom tried to run away from the situation and died doing so.

The real question though is was Tom actually trying to run away from the prison or did the prison guards kill him on purpose... 17 bullets... i hv no clue
