Peter Burnett was the first Governor of the US State of California. California had previously been controlled by Spain from 1769 until 1822 as California Nueva, Las Californias and Alta California. Mexican Governors were in control of Alta California from 1822 until 1846 when it became an independent Republic of California under President William Ide and then a series of American Military Governors from 1846 until Statehood.
California became a state on September 9, 1850. The first governor was Peter Hardeman Burnett, who was elected almost a year prior and continued as the governor after statehood. The first governor to BECOME governor AFTER statehood was John McDougal who, as the then Lieutenant Governor, was elevated to Governor when Burnett resigned in 1851. The first governor ELECTED after statehood was granted was California's 3rd governor, John Bigler, who was elected in 1852. California's 2nd Governor, John McDougal was elected as Lieutenant Governor before California became a state and succeed Burnett as governor upon Burnett's resignation - never having been elected as governor.

Election of governor, lieutenant governor and cabinet members; qualifications; terms.-- (b) When elected, the governor, lieutenant governor and each cabinet member must be an elector not less than thirty years of age who has resided in the state for the preceding seven years. The attorney general must have been a member of the bar of Florida for the preceding five years. No person who has, or but for resignation would have, served as governor or acting governor for more than six years in two consecutive terms shall be elected governor for the succeeding term.
