Usually they have the title, so I don't know what you mean about that. However if they have a lien on it, they can re-possess the vehicle.

You should call a local attorney for state spectic advice.The seller should either be listed on the title as LEINHOLDER OR have a perfected security interest(UCC filing). If neither of these, things get shaky. Maybe that's why the seller wants the title back so badly. Call an attorney.
