As far as I can tell, the stimulus check is more about the taxes you paid. The amount you would get is calculated on the amount of income and taxes you paid.

Probably not..first off, if your finalized, it's pretty much a done deal.Your refund this year was for income and taxes you had withheld last year...which were prepetition. You could have had all your income withheld....and delayed on filing your return till a year from now...it wouldn't change that the refund is an overpayment of withholding from earning from before you filed...that would have otherwise been able to be used to pay your debtors.This stimulus check...while what the heck it actually is may not be terribly clear....it's easier to say it is just an early refund of your 2008 filing...and hence POST petition.

Payment will either be received as a separate check, in addition to Social Security payments, or appear in accounts as a direct deposit.
If you have made no effort to replace a lost 2009 Tax Refund check, I would guess you are out of luck.

After the IRS accepts your income tax return as you filed the refund check will be issued to you by the IRS and the return period will depend on the way that you filed your income tax return and the way that you requested you refund amount to be be sent to you. So depending on the above it could take from about 110 days to six weeks for you to get your refund amount if it is by mail.

If you are claimed as a dependent on someone else's return you are not eligible for a stimulus rebate. When claiming your mother, assuming that she has not had income over $3,400, a stimulus payment adjustment will be made to your tax rebate that will include the payment for her as well. Example: If you and you and a spouse filed, with your mother as a dependent. And your stimulus payment were to be $300 per exemption, you would receive a total of $900.

Yes a tax return that was filed in the year 2008 would have been for the 2007 tax year income tax return.

If you are married have filed a income tax return as a married filing joint income tax return and you have signed this MFJ income tax you could end up in very serious trouble. YES if you would be entitled to one half of the income tax refund as you would also be required to file the check or the income tax return before it was filed and would also be responsible for all of the information that was entered on the MFJ income tax return.
no. Stimulus payments are not taxable. However there are situations where you might not of gotten enough of a stimulus payment. Therefore you would be qualified for a "Rebate Recovery Credit" with your 08 tax return. Therefore give your tax preparer how much you got for a stimulus payment. They would like to return the unspent money back to American taxpayers.
