United States Law:

State laws vary as to whether you are required to report a crime. In the majority of states, failure to report isn't illegal, but some states have laws that punish individuals who fail to report certain types of crimes.


Generally, as to testifying in a criminal case, a court can serve you with a subpoena to appear as a witness to a crime. The subpoena must inform you as to what testimony is required. A witness can refuse to answer only under special circumstances.

  • If answering would give self incriminating evidence they can avoid answering under the Fifth Amendment.
  • Criminal defendants cannot be forced to testify.
  • A witness cannot be forced to testify against their spouse.
  • A member of the clergy, psychotherapist or the defendant's attorney all have special protection and cannot generally be forced to testify.
  • If the witness is not legally competent due to such factors as age, illness or frailty, they cannot be forced to testify.


Otherwise, you must testify. However, a witness with any issues should consult with an attorney before testifying.
