Snape promised Dumbledore that he would convince Voldemort he was spying on the Order of the Phoenix for the Death Eaters. Really, he was spying on the Death Eaters for the Order and only passing selected information to the Death Eaters.

No. At the time of the Harry Potter story, he was a death eater in the past, but in the meantime he repented, and (despite his unpleasant character!) worked faithfully for Dumbledore, and the Order of the Phoenix. In other words: yes he is a DE, but an unfaithful DE.
They don't use this word before the fourth book, but of course Lucius Malfoy, Peter Pettigrew and Severus Snape (who appear in books 1-3) are indeed Death-Eaters. (Severus Snape was a death eater, then changed sides.)
