In most jurisdictions I am aware of "Simple" Assault (meaning assault with nothing but your hands or fists) is a misdemeanor. It can be charged as a more serious crime depending upon the seriousness of the injuries inflicted on the victim.

∙ 14y agoUnless you are a trained boxer or martial artist, an assault using only your hands (usually called a "Simple Assault") is a misdemeanor. An assault using ANY other kind of weapon (including kicking with your feet) is an "Assault With A Weapon" or "Assault with a Deadly Weapon" or "Assault and Battery," is a felony because of the severe bodily harm that can from from it (this includes the area of trained martial artists and boxers).

∙ 14y agoIf it was just plain assault, without any weapon inolved, it would be a misdemeanor. If a weapon was involved (battery) it would probably be a felony.
