Every crime is illegal or else it wouldn't be a crime :) The answer to your question depends on where you live. If you live in the US, there are some states where adultery is still technically a crime, but it's one of those laws that have been on the books forever and generally are not currently enforced (it would be easy to argue that the law is unconstitutional).
