Even if there were no recording device, any reasonable person would realize their neighbor might be in their yard. They have a legal right to be there any time they want. If you speak loudly enough, they will hear you. You know this. Most people would not have a private conversation under these circumstances. The addition of a recorder doesn't really change this. It can only record what your neighbor would hear if he were standing there. Now, if he were to record you WITHOUT YOUR KNOWLEDGE, and share the recordings with a third party, then you would probably have legal recourse against him. My opinion only!
