Accoroding to the 15 amendment no, however the when you put it in the dumpster it becomes the trash company's property.

Added: It does not actually become "abandoned property" until it is set out on the public way for collection. If the dumpster (or garbage can) is still located on private property it is, at the least, trespassing and/or petit larceny.
