Emulators are legal and roms are illegal. The only way you can have a ROM legally is if you have the game already, someone else who has the original copy gives you one as a gift, or get a noncommercial ROM. I hope I helped.

Unless you are using the roms and emulator in an illegal manner (i.e. to sell or distribute the roms or emulators in digital or hard format), it is 100% legal to use emulators and roms to backup hard copies. In fact, you can make as many copies as you want, as long as they stay in YOUR possession. As a result, even if you obtain the roms and emulators illegally, it is possible that you had hard copies of each and destroyed the hard copies, which prevents prosecution for possession alone impossible. In any case, police and courts have a lot more to do with their time than deal with petty cases of digital piracy, and usually won't waste their time with these matters.
[Ahem]. This matter has been talked about many time and there are probably many questions like this on this site. The thing is that emulators are programs made with a copied code from the actual system or from scratch with similar codes. As far as I know, they are legal as long as you don't sell them, buy them, or screw up the actual sysytems (like a N64(c) emulator on Xbox360(c)).
