This game is not legitimate; it is not endorsed by Nintendo, under development from any official game developer, and will not be released to any game console. Therefore, the question is irrelevant. However, Tails is not in any of the current installations of Super Smash Bros. In fan-created game hacks, which this may refer to, there may be any number of characters not found in the normal games. However, the quality of these games and whether or not they actually qualify for the title of SSB is questionable. Which here means sucks.
No, Tails is not a playable character in Brawl.

The first game was Super Smash Bros. on the Nintendo 64 in Japan on January 21, 1999, in North America on April 26, 1999, and in Europe on November 19, 1999.Super Smash Bros. is the first game in the Super Smash Bros. series, and was followed by Super Smash Bros. Melee for the Nintendo GameCube in 2001 and Super Smash Bros. Brawl for the Wii in 2008. So Super Smash Bros. Brawl is the 3rd installment in the Super Smash Brothers series.
