You probably have a faulty brake light switch
"Stuck" brake lights indicate that the brake light switch on the brake pedal is broken. It should be replaced.
There is a switch just above the brake pedal that is called the brake stoplight switch. When the brake pedal is released, it stops the brake lights from illuminating. Check to make sure the switch is contacting the brake pedal stop where it should. A short term method of not killing the battery would be to unplug the connector to the switch and get a new one. It won't have brake lights when disconnected so I don't recommend driving with it like that. replace the broken switch
Either the brake light switch or on brake pedal there is a button that pushes the switch and it fell out.
Defective battery or something is pulling power from the battery. Check the glove box light, interior lights, trunk light, hood light, brake lights, etc.
Brake Lights do not turn offUsually this is caused by the physical position of the brake light switch not being adjusted properly.
The brake light switch is stuck or out of adjustment. If it is a mechanical switch it is located somewhere on the brake pedal swing arm. If it is a pressure switch it is located near the Master Cylinder.
THE BRAKE LIGHT SWITCH IS NOT PUTTING OUT BATTERY WHENEVER THE BRAKE PEDAL IS PUSHED DOWN. CHECK TO SEE IF BRAKE LIGHTS COME ON WHEN BRAKE PEDAL IS PUSHED DOWN. IF BRAKE LIGHTS COME ON, THEN YOU SHOULD BE ABLE TO SHIFT IT OUT OF PARK. IF NO BRAKE LIGHTS, THEN IT WON'T SHIFT OUT OF PARK. IF THIS IS THE CASE, THEN REPLACE BRAKE LIGHT SWITCH.
The rear lights of your car will still on even if your car was off because the switch was turned on and it will still remain on until the battery's out. Another possibility, if the headlight switch is off and the ignition switch is off, the brake light switch may be out of adjustment or broken and what you're seeing is the brake lights on.

the brake lights are on a separate cuircut,if your brake lights are staying then it will be a fault with the brake light switch. the switch is located under dash,and will be on or very close to brake pedal.

Look up under your dash where the brake pedal is attached, you will see a switch that makes the brake lights turn on when you step on the pedal and off when you leave off the pedal. The switch is probably stuck. In the meantime you could disconnect the negative battery cable so your battery doesn't die.
