How long does a patent last on medicine?

Patents generally last for 20 years from the first date of filing for priority. Patents filed prior to 1995 in the USA, however, may have a duration of 17 years from the date of ISSUE, or 20 years from filing, whichever is longer. Patents on medicine often obtain statutory extensions, under US law, for certain delays caused by FDA review. This can substantially increase the patent duration beyond 20 years.

Do patents expire?

Yes. They are initially good for 20 years, but may be renewed. In the USA and most other countries, expired patents cannot be renewed and the invention is permanently "public domain" property.

How do patents expire?

This information describes only U.S. Patents. For utility applications filed on or after June 8, 1995, the patent expires 20 years from the filing date of the earliest U.S. application to which priority is claimed (excluding provisional applications). For utility applications that were pending on and for patents that were still in force on June 8, 1995, the patent expires either 17 years from the issue date or 20 years from the filing date of the earliest U.S. or international (PCT) application to which priority is claimed (excluding provisional applications), the longer term applying. Design patents expire 14 years from the date of issue.

A design patent is good for how long?

In general, a patent can be maintained for 20 years from the date of its first priority filing. In some pharmaceutical cases delayed by the FDA, the date can be extended somewhat. However, a patent filed in the USA prior to June 1995 may lapse 17 years after date of ISSUE (not filing) or 20 years after date of filing, whichever is later. Patents may also lapse because of non-payment of required maintenance fees, which vary by country. Furthermore, a patent may be ruled completely or partially invalid for any number of reasons, making its protection questionable from that date on. Finally, if a patent is never issued (for one reason or another) or is never filed, or is filed improperly, then it does not protect the invention at all. On a related note: plant patents and design patents (and the like) are generally limited to much shorter periods of protection.

How long does a drug patent last?

TRIPS agreement (applies to drugs after 1989) gives 20 year protection. Prior to that it was 16 years. In many jurisdictions, pharmaceutical patents are elegible for patent term extension. For example, in USA, a patentee can get an extension of up to 5 years for a specific product o process (not the full scope of a claim) beyond the 20 year term for an FDA approved product. Variations on such extensions exist in many but not all jurisdictions.
